Agent fined for skipping training

A real estate agent in Western Australia has been fined for failing to complete Continuing Professional Development (CPD) training.

Cottesloe real state agent Charles Clarke has been reprimanded and fined $1,000 by Western Australia’s State Administrative Tribunal for failing to meet the special requirements on his certificate of registrations.

The agent’s registration expired in April 2017, and when he applied for its renewal more than a year later, it came with strings attached. His new certificate was issued, but he had to complete his outstanding training by October 2018.

Mr Clarke failed to complete the training within the time frame, which breached the Real Estate and Business Agents Act.

The annual training is required to meet agents’ licensing conditions, Consumer Protections Commissioner David Hillyard said.

“The CPD training is aimed at assisting industry participants to update their knowledge and skills in the area of industry developments, legislative changes and work practices to maintain high professional standards,” Mr Hillyard said.

“Failure to complete the CPD requirements could result in disciplinary action being taken and licences or registrations not being renewed, or being suspended by the SAT. So, the consequences of non-compliance can be serious.

“Real estate agencies have a responsibility to ensure their employees comply with the requirement to meet their CPD obligations. Consumer Protection encourages agents to check with their employees to ensure that their CPD compliance is up to date.”

Mr Clarke has since completed the training.
