Qld property manager banned for flouting licencing laws

A Carseldine property manager who was found to be leasing dwellings and operating a trust account even though her licence had expired has been disqualified and fined $3,000.

Pleading guilty in Sandgate Magistrates Court on 1 December 2021, Maree Keryn Tynan, who was the sole director of M & R Tynan Managements, has been banned from holding a licence or registration certificate under the Property Occupations Act 2014.

Ms Tynan and her company were first issued resident letting licences on 9 July 2010, at which point she began operating a business and opened a trust account in the corporation’s name to handle transactions on behalf of the residents and owners.

The licences expired on 9 July 2013 and were not renewed. The Office of Fair Trading began looking into Ms Tynan’s affairs in late 2016, resulting in action being taken against her and the company for trading without a licence from 2013 to 2016.

The company subsequently obtained a new licence on 19 December 2016, which then expired on 19 December 2017 and was not renewed. 

Ms Tynan continued to operate through to 6 July 2020, despite the fact that she had not applied for a new licence during this time frame, the corporation’s licence had expired, and that ASIC had deregistered the company on 3 November 2019. 

Commissioner for Fair Trading Victoria Thomson said that the verdict emphasised the importance of property managers following the regulations.

“People put their trust in agents to do things by the book when managing their expensive investments, so it is important that they take licencing laws seriously,” Ms Thomson said.

“The OFT will continue to take action against individuals who operate as resident letting agents without holding the appropriate licence,” she warned.
