Making headlines this week, The Australian Financial Review reported that a real estate agent has been awarded $167,000 in damages for suffering at the hands of a bank error.
Former Century 21 real estate agent Paul Atkas sued Westpac over 30 cheques that he had cashed with the major, which had bounced as a result of a bank system error.
According to the report, Mr Atkas took the case to the High Court, claiming that Westpac's error had resulted in the defamation of Mr Atkas when he had to tell 30 clients their cheques had bounced. He claimed he lost significant business as a result of the banking error.
Mr Atkas' original claim for over $2 million was rejected by the High Court after Mr Atkas refused an offer from Wesptac to write personally to each of Mr Atkas' clients explaining the mistake.
