NSW underquoting legislation is about to be put under the microscope in a court case that could shape the state’s real estate practice.
High-profile Sydney agency BresicWhitney is scheduled to appear in Parramatta Local Court today after being charged in March with underquoting.
The case proceeded to trial after BresicWhitney pleaded not guilty in the Parramatta Local Court in July.
This is believed to be the first prosecution of its kind under the Property, Stock and Business Agents Act 2002, a NSW Fair Trading spokesperson told REB at the time.
This case could therefore create legal precedent for future underquoting cases.
Magistrate Joan Baptie will preside over the trial, which has been scheduled for today and tomorrow.
